Dispute resolution and litigation

We have extensive experience in resolving business disputes and conducting commercial litigation. We advocate alternative dispute resolution in almost all cases but where litigation becomes unavoidable we fight tenaciously to protect our clients’ interests.

We have a strong reputation for our innovative approach to resolving difficulties quickly and cost effectively. Our office is located directly opposite the High Court allowing us to act quickly to obtain court injunctions if that is necessary.  We are also well versed in County Court litigation.

For all clients no matter the size of the case a senior fee earner leads the work and that individual will be responsible, with assistance from other solicitors, for identifying claims and defences and advising on the likelihood of success.  We pride ourselves on developing a strategy for resolution and providing effective representation in courts and statutory and regulatory tribunals.

We keenly support the resolution of disputes through alternative means which usually means by way of mediation.  There are three accredited mediators in the firm and our knowledge of the theory and practice of mediation makes us easily able to use our skills for our clients’ benefit in the mediation forum.  You can read more about mediation in the relevant section of this website.

Our charges are transparently calculated and always agreed in advance.  We are able to arrange costs funding where appropriate.

Mediation

Nobody wants to be involved in a dispute but if you are it is vital to have the support and advice of a team that has taken advantage of the wide and growing developments in the world of dispute resolution and understand the benefits of seeking solutions rather than fights. We are proud of our record of resolving disputes through alternative means which usually means by mediation.

As part of the Bilmes Solicitors dispute resolution team we have accredited mediators in the firm and our knowledge of the theory and practice of mediation makes us easily able to use our skills for our clients’ benefit. We have extensive experience in successfully assisting our clients in mediation, averting the need for costly arbitration or litigation.

Mediation is a voluntary process and it is not a form of resolution which can force a result. Court based dispute resolution in England requires disputing parties to consider mediation as an alternative to trial with the outcome being decided by a judge. When successful mediation brings parties together to better understand their differences and averts the legal costs associated with forcing a resolution through the court system. Disputes can often be resolved in a shorter time and relationships preserved, which is less likely given the bruising nature of litigation. However, while attendance at mediation can be encouraged by the court, willingness to participate and search for a solution cannot.

Please contact our dispute resolution team to discuss whether mediation is an appropriate option for resolving your dispute. Our charges are transparently calculated and always agreed in advance.

Employment

Our employment law practice covers the full range of employment and human resources issues.

We provide bespoke employment contracts for general workforces and for senior management and directors.  We have particular expertise in working for professional firms and in the education field.

We advise on recruitment, progress at work through job development and appraisal and on pay and benefits.

We organise and conduct redundancy procedures to ensure a fair and effective outcome.  We conduct disciplinary meetings and appeals and defend corporate clients in Employment Tribunals and higher Courts against unfair dismissal and discrimination claims.  We write effective compromise agreements and advise on the enforceability of restrictive covenants.

Corporate and commercial

We bring our multi disciplinary approach to every aspect of our corporate work applying our commercial and forensic skills to all manner of tasks from business and share purchases and sales to organisational advice and guidance against predators. For areas that are outside our direct expertise we work with clients’ other advisers or effect introductions as necessary.

We have expertise in negotiating and writing corporate contracts of all kinds including mergers and acquisitions, shareholder and partnership agreements and terms of business. We conduct due diligence exercises, advise on corporate structures and conduct company reviews and help companies to address the issues surrounding insolvency in their business chain including if necessary their own.

This expertise coupled with our dispute resolution abilities and flexible and proactive approach makes Bilmes Solicitors an attractive provider of corporate and commercial services.

Recovery of funds

Our debt collection group will turn your unpaid invoices into cash without stress or trouble on your behalf.  Bilmes Solicitors is experienced at collecting debts for a broad range of businesses.  We are quick and efficient and know how to apply pressure and how to preserve important relationships.  Although we take advantage of all modern technology we use lawyers and not junior staff and send no automated correspondence.

We charge 15% of the face value of invoices but only take that from money we collect.  We automatically add the interest and debt collection charge authorised by law and that frequently covers the full liability to us.  If you have to sue we may act on a “no win – no fee” basis and only collect our fees from the debtor.

All you have to do is call us and we will arrange to collect your invoices, process them and recover your money for transfer to your account.

Costs funding

We understand undertaking legal action is often distressing enough without additional worry about unforeseen costs. We always provide transparent information about our charges up front. We offer all potential clients an initial consultation without charge. Should any aspect of your matter change we will agree any amendments to the fee schedule in advance to ensure there are no surprises.

We evaluate each matter on a case by case basis and in some instances can be flexible about our payment terms.

Should you need assistance with covering legal fees we may be able to offer you our fees funding facilities by way of a fees loan. If you would like more information on funding please contact us directly.

Services for Individuals

Private client work is at the heart of our practice. We pride ourselves on offering an open sympathetic response tailored to meet the needs and requirements of individual clients in all circumstances. We provide straightforward information about our transparent charges.

The advice that individuals require is as diverse as the clientele we serve. Please contact us directly to discuss your matter or click on the icons below for further information.

Dispute resolution and litigation

Each member of our dispute resolution team is highly skilled in managing and resolving disputes by informal means as well as by traditional litigation.  We have a strong reputation for our innovative approach to resolving problems quickly and cost effectively.

For all clients no matter the size of the case a senior fee earner leads the work and that individual will be responsible, with assistance from other solicitors, for identifying claims and defences and advising on the likelihood of success.  We pride ourselves on developing a strategy for favourable resolution and providing effective representation in courts and statutory and regulatory tribunals.

Our charges are transparently calculated and always agreed in advance.  We always offer fixed fees and can where appropriate fund our client’s costs through a lender.

Mediation

Nobody wants to be involved in a dispute but if you are it is vital to have the support and advice of a team that has taken advantage of the wide and growing developments in the world of dispute resolution and understand the benefits of seeking solutions rather than fights. Please contact our dispute resolution team to discuss whether mediation is an appropriate option for resolving your dispute. Our charges are calculated transparently and always agreed in advance.

Family

No two families are the same and no two family problems identical.  Our family law department has over thirty years’ experience in advising clients on all manner of family difficulties from straightforward divorce to complex and high value cases involving the breakdown of relationships, trusts of land applications, disputes concerning wills and trusts and civil child abduction cases. We are equally at home with civil partnerships and with opposite sex relationships outside marriage.

Whether you are getting divorced, seeking contact with your children or wanting a pre or post-nuptial agreement we have the expertise to give you the right advice and the advocacy skills required to represent you if that become necessary.

We settle many family disputes by mediation and other forms of structured negotiation which is often quicker, less expensive and more likely to preserve relationships than traditional Court proceedings.

We provide practical and sympathetic advice in a cost effective manner.  We fully understand the need to be flexible and available and we achieve both.  Our charges are transparently calculated and always agreed in advance.  We are able to arrange costs funding where appropriate.  Please see the Funding section of this website for more information.

An email or telephone call will put you in touch with a member of the family law team.

Employment

Work is supposed to be fulfilling and financially rewarding but if things go wrong it can be disappointing and dispiriting. If your employment rights have been denied or your employer has broken the terms of your contract we can help you secure the redress to which you are entitled through negotiation, mediation or ultimately through the Employment Tribunal or Courts systems. We are practised employment law advocates up to and including the Employment Appeal Tribunal.

We have advised and represented individuals involved in employment disputes in areas such as:

  • Unfair Dismissal
  • Constructive Unfair Dismissal
  • Unfair selection for redundancy
  • Sex, race and disability discrimination

Costs issues are bound to arise and we take clients through how much our work will cost and how it can be paid. We accept instructions from clients with insurance backing. We are able to arrange costs funding where appropriate. Please see the Funding section of this website for more information.

When matters are settled amicably we can deal with compromise agreements and we often act for senior staff in negotiations before they take up a new position including dealing with restrictive covenants and press releases.

Residential property

There are three things which set us aside from other firms in the provision of residential property services: our commitment to communication so that you are kept fully up to date with your sale or purchase at all times; our resolve to make the process as smooth and stress-free as humanly possible; and the fact that we care about you and your home.

As with all our work we offer a transparent and fair charging system which is explained and agreed in advance.

Whether you are moving home, extending your lease, buying an investment property, or simply need some advice about your potential Stamp Duty Land Tax liability please feel free to contact us to discuss your needs.

Immigration

For Bilmes Solicitors immigration work is often part of our family law team’s remit because we are engaged in securing the entry of prospective partners, be they prospective spouses or civil partners.  We are good at it because we devote the right level of resources and the right amount of attention to detail.  We often succeed where others have failed and frequently take on cases from other solicitors and other types of advisers who have ground to a halt.

We also obtain business visas helping established and start-up entrepreneurs to remain in or come to the United Kingdom.  These clients can also benefit from our business management expertise.

Our clients also come from those whose permission to remain has expired or whose presence here has always been illegal. We specialise in Appeals and have an excellent team to give our clients the best chance of obtaining permission to remain in the United Kingdom.

Private Office

It is integral to our services to individuals and families that we are able to provide comprehensive advice about the effective management of their personal affairs.

We deal with lifetime arrangements including lasting powers of attorney and appointment of deputies by the Court of Protection. We write wills and advise on related taxation. We advise executors and administrators and manage the administration of estates.

We do not provide investment advice but do assist in the administration of portfolios held by trusts and individuals both in the United Kingdom and overseas.

The advice we provide in these fields extends beyond the strict limits of legal practice and draw on our wide experience and knowledge of private client management.

Direito do trabalho

A nossa área de prática do direito do trabalho cobre todas as questões de natureza laboral e dos recursos humanos.

Direito do trabalho
